    If you are able to file gc why do you need this. Only future H1bs need to bother about the this restriction. Corporations or Compete America will lobby to remove H1b restrictions if that creates problem for them.

    I am about to e-mail to the Senators based on the new letter.

    Folks, but I have a simple question. Is the following provision addressed by IV when contacting the Senators or not ?


    Placement of employees at client site(Consulting business practices): Under the proposed bill one cannot place H1B employees at another employer�s site (common in consulting business) whether you are H1B-dependent-employer or not. Today, the law places that restriction only on H1B-dependent-employers. This proposed law applies that restriction of outplacement on all employers across the board.

    On July 15th I have filed for renewal of EAD for both of us, today I got approval email where as my wife status says received and pending and NO LUD either. Infact she needs EAD as she is been working on EAD and it expires in October. I am on H1. Why like that? My PD will be current from September as per September bulletin.

    My husband's EAD was approved last week. I filed both the EADs (for me and him) together in July (Receipt Date: July 30th). My application has no LUD so far. His EAD was approved last week. This is just weird. When both the applications were filed together why look at one and not look at the other?

    your spouses will get their EAD approvals in week to 10 days for sure.

    "Mind my language", clearly this must be a case of lost in translation. I am not entitled more or less, IV can close shop today, I did not come to the USA because there was EB1/2/3 or IV fighting my battles, enjoy your journey. Stop whining, there are millions of Americans suffering, don't tell me just because you know java you are better than them.

    Oh BTW, if your toilet broke down, do not panic, shut your door tight get some air freshner, and then you could consider the pretty girl.
    And if my toilet broke down, I will hire a plumber for an hour to fix it, I will not let the plumber move into a room in my house.
    What are you expecting? You want IV to get you salvation?

    Well said!. It is simply a sign of immaturity that some people will just complain but are not willing to do the work , not willing to understand the issue and not willing to understaing the constraints.

    If any changes need to be made it upto the individuals to take the intiatives.




    DO NOT post such baseless allegations.

    IV core is very much aware of the problems as we ourselves face them, and working within our limited means and time. If you are interested, join us and give your helping hand.

    PD Aug 2004, EB-2 India
    I-140/I-485 applied - August 2007 at TSC (non-concurrent)
    I-140 approval - March 2008
    Spouse 485/AP/EAD applied - August 2008 (received receipt notices)
    Self EAD applied - August 2008 (received receipt notices)

    Till date I have not received my FP notice. I applied for my EAD (even though I am not planning on using it) hoping to jump start my pending 485 and get the things rolling for FP and processing of 485. Surprisingly, I got my EAD approval email on Aug 17th and I received my EAD card in the mail yesterday. It is valid for 2 years. It says finger prints not available. No change in the pending 485 status.

    I am totally perplexed about receiving the EAD without FP and so is my attorney. Can someone give me an idea of what is going on? Any input is appreciated! Thanks much!


    Congrats on EAD renewal. Enjoy and relax; please donot get in habbit of worry for anything and everything.

    Anyways, paper based ead renewal donot require finger prints. Search the forum, this has been stated many time.

    If you use AP you enter the US as a "parolee". (Is that how you spell it?).
    If you use AVR I believe you enter as an H1B. I would prefer to enter as an H1B
    since I have not yet used my EAD or AC21.


    Just wondering if anyone on the forum has experience at Ottawa international while returning with either AVR or AP. Also, is there a preference if you have both AVR and AP, what to use to enter back into US? Thanks.

    It is indeed sad that you continue to pontificate from a perch of indifference and ignorance.

    From your knowledge of words it sounds to me that you should get a "PhD" in language or politics or something like that and apply for EB1...Why are you doing EB3???


    If we were to buy this weak attempt at making a 'logical point', I would be glad to give Ron a call and have his folks look into YOUR respective EB2 applications and find out if there REALLY was "NO" qualified US worker available for that job. Want to play that game?

    Look, the EB system is what it is. Instead of trying to bait others into silence by suddenly finding 'fairness in this system', only because this part of the puzzle narrowly goes to serve / protect your gains ... try to come together to fix the underlying weakness in the system.

    For the record, I am not bitter about a 7+ year 'wait'. On the contrary, I have grown professionally thanks to the opportunity to focus my energies towards building a Billion dollar corporation. That said, I would LOVE to see the paperwork of EB2 Java 'gurus' and L1 converts stand up to true scrutiny ... and that would open a whole new can of worms. Game?

    Keep in mind, here you are challenging the entire system...you are challenging DOL, DOS and USCIS integrity...

    I do not like to annoy anyone ever, but your posts are so annoying that I could not resist. Forgive me if I offended you.

    An honest advise: (and please do not take me wrong): you mentioned earlier that you have qualification for EB2. If I were you, I would definitely pursue the conversion from EB3 to EB2 before it gets even tougher to do so. And this is not jost for you or even EB3, this applies to EB2 as well. Every EB2 should try to get EB1. Going higher up in hierarchy is only beneficial.

    Got receipt notice for I-485/AP/EAD/ from USCIS today (8/30/2007). My package was delivered to Nebraska center on July/27/2007. Notice date is August 21st, 2007. My priority date is Dec/23rd/2003.

    Why is the US the be all and end all of your life and career? Is Canada out of the question? It's not always rosey up there, but schools are just as good if not better than US, generally safer and less xenphobic, and they will welcome and appreciate your skills; pay you a fair wage (that through hard work and good relationships you can ratchet up over the years), and welcome your family. CAD is going up. US dollar is going down.

    Did you know that most large, publicaly traded, US hi-tech and financial juggernauts have thriving offices in Canada (to take advantage of high skiled quality workforce)? Intel, HP, Agilent, Cisco, Microsoft, IBM, AMD, etc. Start applying. And guess what, if you really pine for the start and stripes, you can work your way to a transfer back on an L1 visa which may up your EB category and reduce your wait time.
